Hague Apostille Convention, 1961
Marriage Certificate Apostille & Attestation
An Indian marriage certificate is not automatically accepted overseas. For countries in the Hague Apostille Convention it needs an apostille from the Ministry of External Affairs; for others it needs MEA attestation followed by attestation at that country’s embassy in India.

Apostille or attestation — which one you need
It depends entirely on the destination country.
- Apostille applies if the destination is a party to the Hague Apostille Convention, 1961 — which covers most of Europe, the United States, the United Kingdom, Australia and many others. India joined in 2005. One MEA sticker and the document is accepted; no embassy step.
- Attestation applies to countries outside the Convention, including most of the Gulf. The chain is longer: state-level authentication, then MEA attestation, then attestation by that country’s embassy or consulate in India.
Get this wrong and you pay twice and wait twice. Confirm the destination country’s current status before starting, since the list of Convention parties changes.
The sequence, in order
- Obtain the marriage certificate from the Registrar of Marriages or the Marriage Officer. Apostille runs on the certificate, so nothing can start before this exists.
- State-level authentication — by the Home Department, the SDM, or another designated authority in the issuing state, depending on the document and state.
- MEA apostille or attestation, handled through the Ministry’s authorised outsourced service centres rather than at the counter directly.
- Embassy attestation, only for non-Convention countries, at that country’s mission in India.
- Translation, where the destination requires the document in another language. Whether translation happens before or after apostille depends on the country — check, because redoing it is expensive.
What it is used for
- Spouse, dependant and partner visa applications
- Permanent residence and citizenship filings
- Family reunification applications
- Registering the marriage with a foreign spouse’s home authorities
- Name changes on foreign passports and identity documents
- Overseas banking, insurance, employment and school admissions
Common ways this goes wrong
- Apostilling a photocopy. The original or a properly certified copy is required. Attesting the wrong artefact is the most common reason for rejection.
- Name mismatches. A middle name that appears on the certificate but not the passport will be queried by the receiving authority even after a valid apostille.
- Doing it in the wrong order. State authentication before MEA, MEA before embassy. Skipping a step means starting again.
- Leaving India first. Doable but slower and more expensive. If you are travelling, build the apostille into the trip.
- Expired validity. Some countries treat attested documents as valid only for a limited period. Check before you attest, not after.
Timelines
Apostille is generally the quicker of the two, often completing in around a week for a clean document. Full attestation chains run longer because the embassy stage depends on that mission’s own processing. Assume five to twenty working days overall and build slack into any visa deadline that depends on it.
Questions people ask
What is an apostille?
A certificate issued under the Hague Convention of 1961 that authenticates a public document for use in another member country. In India it is issued by the Ministry of External Affairs and removes the need for embassy attestation.
Which countries accept an apostille?
All parties to the Hague Apostille Convention, which includes most of Europe, the US, UK, Australia and many others. Countries outside it — most Gulf states, for example — require the full attestation chain instead.
Do I need the original marriage certificate?
Yes. Apostille and attestation are performed on the original or a properly certified copy, never on an ordinary photocopy.
Can this be done after I leave India?
It can, through a representative holding the documents and a properly executed authorisation, but it is slower and costlier than doing it while you are here.
How long is an apostille valid?
The apostille itself does not expire, but some receiving countries only accept attested documents issued within a certain window — often six months. Confirm with the authority you are submitting to.
