The mistake that costs people a visa

We meet couples every month who married by Arya Samaj rites two or three years ago, never registered it, and have now discovered that at a consular appointment. It is fixable, but it is a much easier problem to solve in the same week as the wedding than three years later.

What the 1937 Act does

The Arya Marriage Validation Act, 1937 was passed to remove doubt about marriages performed between Arya Samajists according to Vedic rites, including between people of different castes. It declares such marriages valid notwithstanding any difference in caste, creed or sub-community. That is a short statute doing a large amount of work — it is one of the reasons Arya Samaj weddings became the practical route for inter-caste couples long before the Special Marriage Act existed.

The ceremony itself follows Vedic ritual: the havan, the recitation of mantras, the saptapadi or seven steps, and the vows. It is conducted by an Arya Samaj priest at a registered mandir, in the presence of witnesses.

What the ceremony requires

• Groom 21 or over, bride 18 or over — age proof for both
• Both parties unmarried, or divorced with the decree, or widowed with the death certificate
• Photo identity and address proof for both
• Passport-size photographs
• Two witnesses with their own identity documents
• An affidavit of marital status, and in some mandirs an affidavit confirming acceptance of Arya Samaj principles
• For a foreign national: passport, valid visa and a No Impediment Certificate from their embassy

Most Arya Samaj mandirs in Delhi NCR can conduct the ceremony on the same day if the paperwork is in order and the parties arrive early enough. The whole ritual usually takes between one and two hours.

Who chooses this route, and why

• Inter-caste couples. The 1937 Act expressly validates marriages across caste lines, and Arya Samaj as a reform movement has always accepted them.
• Couples who want speed with ceremony. There is no 30-day notice, unlike the Special Marriage Act, but there is still a real wedding rather than a signature at a counter.
• Couples wanting a small, low-cost wedding. The ceremony is simple and the cost is a fraction of a banquet-hall wedding.
• NRIs on short visits. Ceremony one day, registration soon after, back on the flight with a file that can be apostilled.

It is not the right route if one party is Muslim, Christian or Parsi and does not wish to be treated as Hindu for the purposes of the marriage. Conversion for convenience creates problems later. That situation calls for the Special Marriage Act.

Getting it registered afterwards

Registration runs under Section 8 of the Hindu Marriage Act, 1955 and the rules of the state where you file. You will need everything you took to the mandir, plus:

• The Arya Samaj marriage certificate itself
• Photographs of the ceremony, showing the havan and the rites
• The priest’s certificate on mandir letterhead
• Two witnesses, ideally the same ones who attended

In Delhi the file goes to the SDM of the relevant district; in Gurugram to the Registrar of Marriages under the Haryana Act. We normally schedule the registration appointment before the ceremony, so the two run back to back rather than the second slipping by months.

Questions people ask

Is an Arya Samaj marriage legally valid in India?

Yes. It is valid under the Arya Marriage Validation Act, 1937 when performed according to Vedic rites between eligible parties. But you should still register it to obtain a government marriage certificate.

Is the Arya Samaj certificate enough for a visa or passport?

No. Consulates, passport offices and banks require the certificate issued by the Registrar of Marriages. The Arya Samaj certificate is proof that the ceremony happened, which is what you use to obtain the government certificate.

Can an inter-caste couple marry at an Arya Samaj mandir?

Yes. The 1937 Act specifically validates marriages between Arya Samajists regardless of caste, and this has been one of the main reasons couples choose the route.

Can a Muslim, Christian or Parsi marry under Arya Samaj rites?

Not without conversion, which we would generally advise against doing purely as a formality. The Special Marriage Act, 1954 lets an inter-faith couple marry with no conversion at all and is the sounder route.

How long does the ceremony take?

Typically one to two hours at the mandir, and it can usually be arranged the same day if documents and witnesses are ready.

We married by Arya Samaj rites years ago and never registered. What now?

You can still register. You will need the Arya Samaj certificate, ceremony photographs, the priest's certificate and an affidavit explaining the delay. It takes longer than a fresh registration but it is routine work.
